Regulatory Framework

GMOs are regulated through EU, UK and Scottish legislation, each of which requires risk assessments to be carried out at every phase of their development. For plants, genetic transformation starts in a laboratory, progresses to the growing of successfully transformed plants in glasshouses, field trials and finally commercialisation of a GM plant variety and its products.

The GMO legislation is divided into two areas:

  1. Contained Use ? covering work with GMOs in containment (The Genetically Modified organisms (Contained Use) Regulations 2000 (GMO (CU)) and

  2. Deliberate Release  ? covering GMOs which have been released into the environment for either research and development trials or marketing (The Environmental Protection Act (1990) and The Genetically Modified (Deliberate Release) (Scotland) Regulations 2002).
